1. Acceptance of Terms & Entity Information

Welcome to RentNearby (accessible at rentnearby.shop), a digital SaaS platform operated by RentNearby Technologies / True Attendly ("Company", "we", "us", or "our").

By accessing or using our website, Mobile Web Application, vendor dashboards, or rental services, you ("User", "Merchant", "Shop Owner", or "Renter") agree to be bound by these Terms & Conditions. If you do not agree to these terms, you may not access or use the platform.

2. Platform Scope & Marketplace Model

RentNearby functions as a software-as-a-service (SaaS) directory and rental workflow tool connecting local equipment merchants ("Shop Owners") with renters.

• Direct Peer-to-Peer Transactions: Rental agreements, item condition verification, identity collection, and security deposit handling occur directly between the Merchant and Renter.
• Zero Transaction Commission: RentNearby does not charge per-booking commissions. Shop Owners retain 100% of their daily rental revenues and security deposits.
• SaaS Subscription Model: Access to store listing management is billed under our subscription engine (Starter, Standard, Pro tiers).

3. Subscription Engine & Billing Tiers

Merchant stores are billed according to our 3-tier subscription framework:

New merchants receive a mandatory 14-Day Free Trial with full access to Starter features. Upon trial end, merchants may upgrade to active billing or remain on standard free tier with restricted listing creation guards.

4. Security Deposits & Equipment Liability

Renters are solely responsible for inspecting equipment during handover. Shop Owners utilize our built-in Handover Verification Wizard to upload live photographic proof, inspect physical condition, and collect government-issued ID proofs.

In the event of lost, stolen, or damaged equipment, the Renter is liable for the full replacement cost or repair charges as specified in the merchant’s individual rental voucher agreement. RentNearby is not an insurer and holds no financial liability for lost or damaged goods.

5. User Conduct & Prohibited Uses

Users shall not:

• Post fraudulent equipment listings, stolen items, or illegal contraband.
• Misrepresent equipment identity, technical specifications, or physical working condition.
• Use automated scrapers, bots, or malicious exploits against the RentNearby system.

6. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the Republic of India. Any legal action or proceeding arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Bengaluru, Karnataka or Kozhikode, Kerala, India.
